DMCA Policy

This policy explains two distinct things, because Framis sits on both sides of a copyright dispute depending on context: (1) how to report content hosted on framis.app itself that you believe infringes your copyright, and (2) how to dispute a takedown notice that Framis has filed with a third-party hosting provider on behalf of one of our photographer clients. 1. Reporting infringing content hosted on framis.app

Framis hosts photographic libraries uploaded by our photographer users. Photographers warrant that the images they upload are their own work (Terms of Service §2). If you believe an image or other material hosted on framis.app itself infringes your copyright, you may submit a takedown notice to our Designated Agent (see §4). A valid notice under 17 U.S.C. §512(c)(3) must include:

  • A physical or electronic signature of the copyright owner or a person authorised to act on their behalf.
  • Identification of the copyrighted work claimed to have been infringed.
  • Identification of the material claimed to be infringing, with enough detail (e.g. the specific framis.app URL) for us to locate it.
  • Your contact information — address, telephone number, and email address.
  • A statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent, or the law.
  • A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorised to act on the owner’s behalf.

On receipt of a compliant notice we will act expeditiously to remove or disable access to the identified material and will notify the affected photographer, who may submit a counter-notice under §3 below.

2. Notices Framis files on your behalf (as your agent)

When you enable the DMCA/takedown option in your Recovery Tactics settings, Framis may file a copyright takedown notice with a third-party website’s hosting provider on your behalf, identifying your photograph as used without authorisation on their site. This is described in Terms of Service §8 and Recovery Terms §7. Framis does not host the infringing website in these cases — the notice goes to the infringer’s own hosting provider, not to us, and any statutory counter-notice process the recipient may have runs against that provider under the provider’s own DMCA policy, not against Framis.

That said, we want a straightforward path to resolve disputes about notices filed in our name. Anyone who has received a takedown notice from Framis and disputes it may contact us directly (§4) rather than only going through the hosting provider.

3. Disputing a notice Framis filed on a photographer's behalf

If you receive a takedown notice that Framis filed on behalf of a photographer client and you believe the removal was made in error — for example, you hold a valid licence, the use is fair use/fair dealing, or the material is not actually the photographer’s work — you may send us a counter-notice. A counter-notice we can act on should include:

  • Your physical or electronic signature.
  • Identification of the material and its location before removal.
  • A statement, under penalty of perjury, that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
  • Your name, address, and telephone number.
  • A statement that you consent to the jurisdiction of the relevant federal district court (for US-hosted matters) or the appropriate court under the applicable regime described in Terms of Service §8, and that you will accept service of process from the person who provided the original notice or their agent.

Send counter-notices to our Designated Agent (§4). Because the notice itself was sent to your hosting provider rather than filed against content on framis.app, resolving a dispute may also require you to pursue your provider’s own DMCA process in parallel — we cannot compel a third-party host to act, but where we can, we will work with the hosting provider to withdraw a notice we filed once a dispute is resolved (see Recovery Terms §7.3 on withdrawal, including that withdrawal speed cannot be guaranteed once a provider’s removal process has started).

Notices sent to any other address (including general enquiries or the copyright holder’s own outreach thread) will be forwarded internally where possible, but using the address above ensures the fastest response.

5. Misrepresentation

Submitting a knowingly false takedown notice or counter-notice may expose you to liability for damages, including costs and attorneys’ fees, under 17 U.S.C. §512(f) or the equivalent provision of the applicable regime described in Terms of Service §8. Please make sure a notice or counter-notice is accurate before sending it.
